01General provisions
This Privacy Policy sets out how the personal data of users of the melnychenko.law website (the “Website”) is processed. The controller of personal data is attorney Serhii [Patronymic] Melnychenko (certificate of the right to practise law No. 0000 of 00.00.2014 issued by the Kyiv City Bar Council), practising as Melnychenko Law Office, address: Office 00, 00 Prykladna St, Kyiv (the “Attorney”, “we”).
The Policy is based on the Constitution of Ukraine, the Law of Ukraine “On Personal Data Protection”, the Law of Ukraine “On the Bar and Practice of Law”, the Rules of Professional Conduct for Attorneys and, for users in the European Union, takes into account the EU General Data Protection Regulation (GDPR).
By using the Website and sending us your data, you confirm that you have read this Policy.
02What data we collect
We process only the data needed to contact you and provide legal assistance:
- Data from the Website forms: name, phone number, email or messenger username, country of residence, preferred contact channel, preferred consultation date.
- A description of your situation that you choose to give in a form or message.
- Correspondence in messengers (WhatsApp, Telegram, Viber, Signal) and by email, if you contact us through these channels.
- Technical data: IP address, browser and device type, pages viewed, date and time of the visit, cookies.
Please do not send scans of documents, bank card details or passwords through the Website forms. We accept case documents once a secure way to transfer them has been agreed.
03Purposes of processing
- To contact you in response to a request, a consultation booking or a media enquiry.
- To assess your situation, provide legal assistance, and conclude and perform a contract.
- To comply with legal requirements, including accounting and reporting.
- To keep the Website running, secure and improving.
04Legal grounds for processing
- Your consent to the processing of personal data, given when you submit a form on the Website.
- Concluding and performing a contract for legal assistance.
- Compliance with obligations imposed on the Attorney by law.
- Legitimate interest — protecting the Website from abuse and spam.
05Attorney–client privilege
Under Article 22 of the Law of Ukraine “On the Bar and Practice of Law”, any information you share with the Attorney, including from your very first message through the Website or a messenger, is protected by attorney–client privilege — even if no contract is ever signed.
Such information may not be disclosed or passed to third parties without your consent, except in cases expressly provided for by law.
06Who may receive the data
We do not sell your data or pass it to third parties for advertising. The data may be processed only by:
- the attorney’s staff and assistants, who are bound by attorney–client privilege;
- technical service providers — Website hosting, email and request notification services — to the extent needed for their work and on terms of confidentiality;
- public authorities — only in the cases and manner expressly established by law, subject to the guarantees of attorney–client privilege.
If data is transferred outside Ukraine (for example, to providers’ servers in the EU), we choose providers that ensure an adequate level of protection.
07Retention period
- Requests from the Website that did not lead to a contract — up to 12 months, after which they are deleted.
- Client data and case materials — for the term of the contract and, after it ends, for the periods set by law and the rules for keeping an attorney’s case file.
- Technical data and cookies — for the periods stated in the section on cookies.
08How we protect data
- A secure HTTPS connection on every page of the Website.
- Restricted, password-protected access to requests: only the Attorney and authorised persons.
- Case documents are stored on secure media and in encrypted services.
- For confidential correspondence we recommend Signal with end-to-end encryption.
09Cookies
The Website uses cookies necessary for it to work (for example, to remember the site language) and, with your consent, analytics cookies for visit statistics. You can turn cookies off in your browser settings — this will not prevent you from contacting us.
10Your rights
Under Article 8 of the Law of Ukraine “On Personal Data Protection”, you have the right to:
- know what data of yours is processed, for what purpose and who has access to it;
- access your data and have it corrected;
- request deletion of your data or an end to its processing, unless this is contrary to law;
- withdraw your consent to processing at any time;
- complain to the Ukrainian Parliament Commissioner for Human Rights or to a court.
To exercise these rights, write to us — we will reply within 30 calendar days at the latest.
